I, the undersigned volunteer, intending to be legally bound, hereby certify that I am physically fit and have not been otherwise informed by a physician. I acknowledge that I am aware of the risks inherent in physically organizing, coordinating, facilitating and otherwise assisting in connection with open water swimming events, including contagious diseases, permanent disability and death, and agree to assume all of those risks.

AS A CONDITION OF MY VOLUNTEER ROLE IN ANY SWIM (“SWIM”) AND ANY ACTIVITIES INCIDENT THERETO, I HEREBY WAIVE ANY AND ALL RIGHTS TO CLAIMS FOR LOSS OR DAMAGES TO MY PERSON OR PROPERTY, INCLUDING ALL CLAIMS FOR LOSS OR DAMAGES CAUSED BY NEGLIGENCE, ACTIVE OR PASSIVE, OF ANY OF THE FOLLOWING: CONEY ISLAND BRIGHTON BEACH OPEN WATER SWIMMERS, NYC PARKS AND RECREATION, THE CITY OF NEW YORK, WCS-THE NEW YORK AQUARIUM, PR TIMING, ANY EVENT SPONSOR, ANY EVENT COMMITTEE, ANY VOLUNTEER, ANY BOATER, AND ANY INDIVIDUAL OFFICIATING AT OR OTHERWISE SUPERVISING THE EVENT. 

In addition, I agree to abide by and be governed by the rules of the Swim to the extent they are applicable to volunteers. Finally, I again acknowledge that I am aware of the risks inherent in physically organizing, coordinating, facilitating and otherwise assisting in connection with open water swimming and agree to assume all of those risks.
